ChecknBuy use Equifax and provides users of the Site (Users) with vehicle information and reports through Equifax online information service (Vehicle Information Service). You will receive Car history report with car history logo which is own by Equifax Pty ltd.
We acknowledge the right of customer’s privacy and created different protocols to assist us to maintain the information accurately, to-date and is not false.

PPSR report are recorded depending upon the sources of Australian government, using the VIN history, PPSR certificate is issued by Australian Financial Security Authority. PPSR report is provided by official Australian government body, using database of PPSR and NEVDIS used in Australia.
Stripe is used to process payments from our customers. We do not hold nor access the payment or payment details. We do not share the email address either with third party.
You agree you have read and understand our Privacy policy. You must abide with our privacy policy which could be updated by us from time to time, However, the Privacy Policy does not constitute the sections of Terms of usage. To extent any Discrepancy, these Terms of Usage exists.
The use of site by the customer is the proof of the customer consent to collect, store, use and distribution of personal information (defined by the Privacy Act 1988) where you provide us with name, email address, you date of birth, gender, residental address and postcode.
The terms and conditions represent the terms of use and regulate the access of customer to and use of the website and the information related to the vehicle, unless there are any exemptions or further terms is applicable. The customer use the website and the information of the vehicle service shows that you have accepted the terms of use. We have right to change the terms of use by announcing the adjustments on the website. If you disagree with the terms of use or/and wish to make any changes which we have published then you must not access the website or the information related to the vehicle.
The customer has the right to ask for the report which is provided by us to you, varying on the CarHistory report pack which you bought during the time of specific upon the acquisition of the CarHistory Report Pack. Refund will not be issued if the Report is not used. CarHistory Reports Packs can not be transferred. The customer would not be provided with any notice in which the reports you order is about to expire.
You agree that we may gather and use the your personal information as the user of the website and other data related to the activity on the website. We may also use unknow and personal information about the activity of user of the side by checking their user name (collected information). The Collected information (all or partial) could be utilised for advertising purposes. When it happens, the collected information would be given to our business partners, You consent that we and our partners could utilise and disclose your personal information to communicate with you about other services which is offered by ChecknBuy or SafeBuy or partner Equifax or our corporate partners and utilise the information for purpose of direct marketing. You agree to accept communication through email, SMS or any other electronic means of communication and also by phone or mail.
You understand that all the material shown on the website, comprising without limiting the information, text, material, graphics, software, tools, results derived from the use of the software and tools, marketing, advertisement, names, logo of ChecknBuy, SafeBuy and trademarks (including the term ‘CarHistory) on the website content are owned by us or license by us and are secured by copyrighs, trademark and other law unless explicitly stated on the website. You must to make usage, modification, reproduction, store, distribution, print, display, publicize, creation of derivative work, download on the computer, upload to a third party, transmission or distribution of the content.
Even if the content is to you in a way which allow you to modify, delivery of the written content in that type does not grant you the authority to modify the content unless it is mention at the time we delivered it to you.
You could see the website using you computer browser and/or save it as an electronic copy or hard/print copy, of the content without making any modification to benefit your personal usage, information, research or study. You must not retrieve or use the website or the content in any other way or for any other objective which is not legal or banned by any law which may be applicable to you or breach our rights in under any circumstances or not allowed by the terms.

You acknowledge that the Vehicle Information Service is supplied online over communications links and other networks, and that the availability of the Site and the Reports rely on the availability of those links and networks. We will take reasonable steps to ensure that any Vehicle Information Service that we choose to provide is available, but we are not responsible if the links or networks are unavailable at any time, and we do not guarantee that the Site, the Vehicle Information Service or the Reports will be continuously available.
In most cases, PPSR is made available all the while. But there are some exceptions to this condition such as:
You acknowledge that we, together with our licensors, own all intellectual property rights (including without limitation all copyright in the layout and manner in which the information in the Reports is compiled) and nothing in these Terms of Use transfers any ownership in the Reports to you. You acknowledge that the Reports may include information that is licensed to us by third parties.
You agree that the Reports are provided to you strictly for your personal use and solely for the purpose for which they are supplied.
If we deliver Reports to you electronically, you are permitted to retain one electronic copy of the Report on your personal computer. You are also entitled to print one hard copy of the Report for your file. Other than the permissions granted in this paragraph, you may not use, reproduce, modify, adapt, transfer, re-sell, re-package or otherwise re-use all or any part of a Report in any way or for any purpose.
If you are a business entity, in addition to the permissions granted in the paragraph above, you may print three copies of the Report for display at your premises and provide hard copies of the Report to potential purchasers.
You acknowledge that your payment details for Reports ordered through the site are received by us and we may provide them to a third party solely for the purpose of processing your payment. That third party will process your payment and you must agree to the terms and conditions of any third party payment processor before your payment will be accepted.
The Site may link to third party sites or collect from those third parties which in turn may contain hyperlinks to further third party sites (collectively Linked Sites). These are provided for your convenience only. You acknowledge that Linked Sites are not under our control and we are not responsible for the content of any of them. The inclusion of any link does not imply any endorsement of the link by us.
You acknowledge that we source information from third parties. You agree that you are responsible for assessing the value of the information we provide you, and for the decisions that you make, regardless of whether you base them on the information we supply.
You acknowledge that in some cases there may be a delay between when an event occurs and when that information is provided to us to record and that we have no control over when third parties choose to report information or events. We do take steps to record the information provided as soon as we can.
You acknowledge that we may not have the complete history of the vehicle on which you order a report. Accordingly, we will not be liable for the refund of any fee paid if the report in question does not provide a full history of the vehicle.
In particular, where information comes from one or more of the named suppliers or reports below the following additional disclaimers apply to the information from that supplier or in respect of that report, as required by those suppliers:
Glass's Information Services has exercised all reasonable care and skill in producing this information. Glass's Information Services gathers its information from independent sources within the motor trade, unconnected with it, and as a result can accept no responsibility for the accuracy or completeness of information. Furthermore, information on valuations supplied are intended as a guide only to current market value; they can not be considered in any way a substitute for a full and detailed inspection of any vehicle.
Personal Property Securities Register (PPSR) - To the extent permitted by law, the PPSR and PPSR Information is made available without any representation or warranty of any kind (without limitation in respect to the accuracy of PPSR Information) and we have no liability to you in respect of any loss or damage that you might suffer no matter how arising (including negligence) that is directly or indirectly related to the PPSR, or PPSR Information.
Certain legislation may imply warranties or conditions or impose other obligations including statutory consumer guarantees which cannot be excluded, restricted or modified except to a limited extent. These Terms of Use must be read subject to those statutory provisions.
To the extent permitted by law, we exclude all express or implied representations, guarantees, conditions, warranties and terms relating to the use of the Site and the Vehicle Information Service that apply under or are implied by statute, custom, law or otherwise, except those set out in these Terms of Use.
If in our supply of the Vehicle Information Service we are liable for a breach of any guarantee, warranty, condition or other term that applies under the Competition and Consumer Act 2010 or is implied by any state or territory law that cannot be excluded, our liability under that legislation is limited, to the extent permitted by law, to the re-supply of the relevant Vehicle Information Service or the payment of the costs of having the Vehicle Information Service supplied again, whichever we elect. In our absolute discretion and instead of either of the foregoing two options, we may elect to refund to you the amount you have paid us for the Vehicle Information Service to which your claim relates.
To the extent permitted by law, we are not liable to you or to anyone else for any loss or damage (including without limitation loss of profit, revenue or business, indirect, consequential, special or incidental loss or damage) which arises or might arise if it were not for this clause.
The Terms of Use are governed by the laws in force in New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts in New South Wales, Australia.
